Who Qualifies for Asylum

To qualify, an applicant must show persecution or a well-founded fear of future persecution tied to one of five protected grounds: race, religion, nationality, political opinion, or membership in a particular social group. A particular social group is defined by a common, immutable characteristic its members share and can’t change. A political opinion claim typically requires showing the applicant holds views the home government won’t tolerate.

Affirmative vs. Defensive Asylum: The Two Filing Paths

How you pursue asylum depends largely on your current immigration status, and the process differs substantially between the two paths.

Affirmative Asylum
If you’re physically present in the United States and not in removal proceedings, you can file Form I-589 directly with USCIS. An asylum officer then conducts a non-adversarial interview to evaluate your claim.

Defensive Asylum
If you’re already in removal proceedings, asylum becomes a defense raised before an immigration judge in adversarial, court-like proceedings. Our attorneys represent clients at those hearings, presenting evidence and testimony to support their right to remain.

Regardless of which path applies, applicants generally must file within one year of their last arrival in the United States. Exceptions exist for changed or extraordinary circumstances that affected the timing, but acting promptly can help protect your options.
