Texas uses the term conservatorship for what most people call legal custody. The two primary arrangements are joint managing conservatorship, where both parents share rights and duties, and sole managing conservatorship, where one parent holds primary decision-making authority. When the original order no longer fits, either parent can petition to change it.

Under Texas Family Code Chapter 156, a custody order can be modified on three grounds: a material and substantial change in circumstances affecting the child or a conservator, the voluntary relinquishment of primary care and possession by the custodial parent for at least six months, or the child’s preference. A child who is at least 12 years old may express that preference directly to the judge in a private in-chambers interview. The judge considers it seriously but isn’t bound by it; the best interest of the child standard still governs the outcome.

Rights and duties adjustments address which parent has authority over medical, educational, and other decisions. The first applies when the order was established or last modified more than three years ago and the current amount differs by at least 20 percent or $100 from what the guidelines would produce based on current income. The second applies at any time if there has been a material and substantial change in circumstances, such as a significant increase or decrease in either parent’s income, a change in the child’s medical needs, or a change in how many children the paying parent supports.

An increase in income can result in a higher support obligation; a reduction may support a request to lower it. Either parent can seek the modification depending on which direction circumstances have moved. As with custody orders, an informal side agreement to pay a different amount carries no legal weight. Only a signed court order changes the obligation.
